The pharmaceutical industry's main lobby group sued on Wednesday to invalidate one piece of the Trump administration's effort to benchmark US drug prices to lower prices overseas, Reuters reported. The suit targets the GLOBE rule, which is meant to set hospital drug prices for Medicare patients.
The final version of the rule, published last week, sets out how a most-favored-nation system based on prices in a group of comparable countries would be applied in Medicare Part B. PhRMA argues the rule is an illegal overreach.
Reuters said the complaint was filed in the US District Court for the District of Columbia against Health Secretary Robert F. Kennedy Jr., the Department of Health and Human Services, the Centers for Medicare and Medicaid Services and related innovation-center officials.
The case is a challenge to a published rule, not a ruling. No hearing date was included in the Reuters account.
